By downloading, installing, or using VibeOut for Owners, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.
You must be at least 21 years of age to use VibeOut for Owners. You must also be authorized to represent a business that serves alcoholic beverages. By using the app, you represent and warrant that you meet these requirements and that your business holds all necessary licenses to operate and promote alcoholic beverage sales.
To use VibeOut for Owners, you must create an account with your name, business name, email address, and a password. You are responsible for:
Your password must be at least 8 characters and include an uppercase letter, a lowercase letter, and a number.
You are solely responsible for the accuracy of your happy hour listings. When creating a listing, you provide the venue name, address, coordinates, hours, active days, deal descriptions, and optionally a menu link. You agree to:
All happy hour listings you create will be publicly visible to all authenticated VibeOut consumer app users. This includes the venue name, address, map location, hours, deal descriptions, and menu link. You acknowledge and consent to this public display when creating a listing.
You are responsible for ensuring that your happy hour promotions and their advertising comply with all applicable local, state, and federal laws and regulations, including alcohol advertising and promotion laws. VibeOut does not verify the legality of your promotions and is not liable for any violations.
VibeOut provides aggregated, anonymous analytics about how VibeOut consumer app users interact with your listings. This includes counts of direction taps, phone calls, menu views, reservation taps, and verified check-ins. You agree that:
You may delete your listings at any time through the app. Deletion is permanent and cannot be undone. Deleted listings will no longer appear to VibeOut consumer app users.
All content, features, and functionality of VibeOut for Owners, including the app design, logos, and code, are owned by VibeOut and protected by intellectual property laws. You retain ownership of the text content you create for your listings but grant VibeOut a license to display that content to users of the VibeOut consumer app.
VibeOut for Owners is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee any specific results, customer traffic, or revenue from listing your happy hours on the platform.
To the fullest extent permitted by law, VibeOut and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app or from customers' reliance on your listings.
We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties. Upon termination, all your listings will be removed from the platform.
We reserve the right to modify these Terms of Use at any time. We will update the "Last Updated" date at the top of this page. Continued use of the app after changes constitutes acceptance of the revised terms.
